1. Agreement Overview

By accessing or using the Thinkbuild website (thinkbuild.me) or engaging our studio for custom web development, mobile app engineering, web design, or software services, you agree to comply with and be bound by these Terms & Conditions.

2. Service Proposals & Scope of Work

All client engagements are governed by a written Statement of Work (SOW) or formal project proposal outlining scope, deliverables, timelines, and pricing. Any requests for additional features or revisions outside the agreed SOW will be evaluated as separate change requests.

3. Intellectual Property Rights

• Client Ownership: Upon receipt of full project payment, all custom code, design assets, website files, and intellectual property created specifically for the project transfer completely to the client.
• Studio Portfolio Rights: Thinkbuild retains the non-exclusive right to showcase completed project work, screenshots, and case studies in our studio portfolio, unless restricted by a mutually signed non-disclosure agreement (NDA).

4. Payment Terms & Milestones

Projects are structured with milestone payments (typically a deposit prior to commencement, mid-project check-ins, and final balance upon staging sign-off). Invoices are payable within 14 calendar days of receipt.

5. Limitation of Liability

Thinkbuild strives for 100% technical excellence and uptime. However, to the maximum extent permitted by law, Thinkbuild shall not be liable for any indirect, incidental, or consequential damages arising out of project delays, third-party API outages, or hosting provider downtime beyond our reasonable control.

6. Governing Law

These Terms & Conditions are governed by and construed in accordance with the laws of India. Any legal proceedings arising from these terms shall be subject to the exclusive jurisdiction of the competent courts in India.
